Terms of business
To ensure that THE SAUCE are able to provide you with the best service in the most efficient manner, we require you to carefully read and agree to the following terms and conditions. Please sign below.
The Client is deemed to have accepted these terms of business by signing this document. If the terms of business are not signed and a candidate is engaged the fee is still payable within the terms of business by the Client to THE SAUCE.
By engaging THE SAUCE to complete all or any of the functions outlined in this agreement, you the client, are showing your acceptance to the terms and conditions as set out below. THE SAUCE will source candidates for the client and fulfill all necessary requirements under the agreement and the client hereby agrees to pay the fee as outlined below.
Unless otherwise agreed in writing the following Fees will apply:
Permanent Fee: 12% Annual Salary Package
* Our fees are based on the type of service we are engaged to provide. Rates are charged on the total package offered to the candidate. Where fees are based on an hourly wage, the fee will be calculated at 45 hours per week. Package is described as base salary plus superannuation and any other guaranteed earnings including company vehicles, valued at $15,000 per annum. Rates quoted and agreed are based on $NZ dollars.
Engagement Fee: $550.00 + GST
Should you wish to engage THE SAUCE to assist you on a search or selection basis, you will be charged an initial ‘Engagement Fee’. This fee covers our initial services committed to commencing the recruitment assignment and ensures the role is given our full attention until an appropriate candidate has been sourced and placed. In addition, by paying a small up front engagement fee, you are demonstrating your commitment to work in partnership with THE SAUCE and at the same time ensuring THE SAUCE’s commitment to the placement of your role. This ‘Engagement Fee’ is not an additional cost and will be subtracted from the final placement fee at the end of the recruitment process. Should however the role be cancelled, the Engagement Fee is non-refundable.
Fixed Term Assignments / Projects: Fees for fixed term assignments or projects are calculated in the same way as a permanent placement and then prorated in accordance with the length of the assignment, with a minimum charge of six months. If a fixed term appointment continues or is extended into a different role after six months, the balance of the relevant permanent placement fee will be payable.
International or Customised Project Recruitment: International or customised project recruitment will be priced by separate proposal.
Consultant Introduction: For Contractors or Consultants introduced by THE SAUCE with no fixed project term or termination date, there will be a minimum fee payable equivalent to six months of the full-time pro-rated remuneration. For a term in excess of six months, further fees will be invoiced bi-monthly. Where a Consultant or Contractor is taken on directly either on a contract or permanent basis, in either the same or a different role, the above permanent placement fees will apply.
Exclusivity Term: The exclusivity term is for the duration of 2 weeks from commencement of the project.
The Client agrees that during the Exclusivity Term it will exclusively use the services of The Sauce for the Introduction of permanent or contract staff. The Client will not use the services of any other employment agency, directly or indirectly.
Guarantee: THE SAUCE offer a 10 week replacement guarantee (of equal or lesser value) on all permanent placements. This guarantee applies from the start date of the successful candidate on the provision that:
* There is a limit of one replacement on any one previously invoiced placement. The terms and conditions of the original employment agreement remain unchanged as per the letter of offer or verbal agreement. Payment for the original placement is made no more than seven days after the candidate start date. The offer of a free replacement expires if it is not completed (i.e. replacement appointed) by the client within six months of the date of the original candidate leaving. The guarantee period is not valid in circumstances that are out of our control for example, but not limited to: restructuring, redundancy.
Guarantee period for Fixed Term Contracts is as follows: 3 months and under = No guarantee. 3 – 6 months = 4 week guarantee. 6 – 12 months = 8 week guarantee. 12 months + = 10 week guarantee.
Candidate + Consultant Ownership: Any Contractor, Consultant, or Candidate introduced and presented by The Sauce remains a candidate of The Sauce for a period of six (6) months following the later of date of original presentation or conclusion of work assignment. If the Candidate is hired by the client, or any other organisation to which the client has referred the Candidate to, in any position, whether contract, temporary or permanent, within this six (6) month period, then the normal Terms of Business and Fees will apply.
Placements: A candidate that is offered and accepts a position anywhere in the client’s organisation is considered a placement, this extends to any position even those outside of the original position listed with The SAUCE or those that the candidate originally applied for.
Reference checking and suitability: THE SAUCE will conduct the required candidate checks, however the client will be responsible for satisfying itself as to the suitability of the candidate prior to engaging that candidate. THE SAUCE will endeavor to ensure that candidates introduced to the client are suitable given the assignment brief provided by the client. However, THE SAUCE takes no responsibility for any untrue statements or misrepresentations made by the candidate or for the accuracy of information provided by the candidate or any third parties as to the suitability of the candidate.
Remittance: The trading terms with THE SAUCE are seven days from candidate start date. Should payment not be received on time, the guarantee will be invalid.
Late Payment Fee: All late payments will incur a 15% administration fee, charged monthly.
Debt Recovery Cost: All Debt Recovery (legal) cost will be added to the Invoice if not paid within terms.
Privacy and confidentiality: The privacy of all persons in the recruitment process is considered to be of utmost importance to THE SAUCE. We respect the confidentiality of information and the privacy of individuals and expect our clients and candidates to do likewise. All personal information, which we provide to your organisation, is provided on a strictly confidential basis and may not be disclosed to a third party without our consent. Your organisation agrees to comply with the Privacy Laws and not to use such information except to the extent necessary to assess the suitability of a Candidate for permanent or contract employment.
Candidate Performance: THE SAUCE shall not be responsible or liable for any losses, costs, expenses or damages however incurred (direct, indirect or consequential) arising out of or in connection with the performance or any actions of the Candidate.
HR/Legal Advice: THE SAUCE may provide advice and guidance on many HR/Recruitment related topics, however we are not qualified employment lawyers. THE SAUCE encourages the client to seek independent legal advice on such matters.
Extras: In order for THE SAUCE to commence working with the client this form must be read and returned to THE SAUCE. Signing below indicates that you have read and agree to the above terms and conditions. Please note that rates are subject to review every 12 months however this agreement remains in force until either party terminates it in writing.
